San Andreas Penal Code 2011

Preface


Attempt - With the exception of crimes that have a specified separate charge for attempt, I.E. murder, any time a person attempts to commit a crime, they are to be charged with the crime they are attempting and punished under the guidelines of the crime they attempted.

Bail - Bail is available for most crimes with the exception of violent crimes and crimes involving intoxication or influence of a controlled substance. A fee is paid in exchange for an amount of time off a person's sentence. Bail must be paid in full for all charges and cannot be done individually. If one of the crimes charged does not have a fixed bail amount, the person may not bail out on any other charges.

Crimes against a person - In order for a person to be arrested for a misdemeanor personal crime or crime against private property with the exception of domestic assault crimes and crimes against children, the victim must choose to press charges against the suspect. If the victim does not press charges, the suspect is to be turned loose. However, if the crime was committed in a public area or in the presence of others, the suspect can be arrested for disturbing the peace. If the crime is a felony, they are charged without victim consent.

Maximum sentencing - The current maximum sentence for incarceration is 11 hours and a $25,000 fine.

Infractions

101. Emergency hotline abuse - Misusing the 911 emergency hotline to report fraudulent or deceitful information.
$5,000 fine

102. Failure to stop - Failing to stop at an area in which stopping is required.
$2,000 fine and one driver warning

103. Failure to yield - Failing to yield to a vehicle with the right-of-way.
$2,500 fine and one driver warning

104. Failure to yield to a pedestrian - Failing to yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.
$2,000 fine and one driver warning

105. Failure to yield to an emergency vehicle - Refusing to pull over when an emergency vehicle with an active siren is in the vicinity.
$5,000 fine

106. Furnishing alcohol to a minor - Serving or selling alcohol to anyone under the age of 21.
$3,000 fine and the revocation of the seller's liquor license

107. Improper parking - Leaving a vehicle unattended in a manor that is dangerous or obstructive.
$1,500 fine and a vehicle impounding

108. Jaywalking - Recklessly or improperly crossing a roadway.
$1,000 fine

109. Loitering - Unlawfully remaining in a particular public place for a protracted time without valid purpose.
$3,000 fine

110. Open liquor container - Having and storing an open container of liquor in a part of your vehicle other than the trunk.
$3,000 fine

111. Parking in a restricted government zone - Leaving a vehicle unattended in a government-owned area in which parking is prohibited.
$2,000 fine and a vehicle impounding

112. Parking in a restricted zone - Leaving a vehicle unattended in an area in which parking is prohibited.
$1,000 fine

113. Possession of marijuana - Possessing marijuana at an amount of under ten grams.
$4,000 fine

114. Possession of unlawful vehicle modifications - Operating or owning a motor vehicle with nitrous oxide systems (NOS).
$2,500 fine, two driver warnings, and vehicle impounding

115. Public urination - Disposing of urine on a street, sidewalk, park, or any other public place.
$1,000 fine

116. Public defecation - Disposing of excrement on a street, sidewalk, park, or any other public place.
$1,500 fine

117. Reckless driving - Any person who drives any vehicle upon a highway in willful or wanton disregard for the safety of persons or property is guilty of reckless driving.
$2,500 fine and one driver warning

118. Selling alcohol without a license - Engaging in a transaction in which alcohol is sold without a proper permit.
$3,000 fine and the confiscation of all alcohol

119. Speeding - Operating a motor vehicle above the legal speed limit.
$2,000 fine and one driver warning

Misdemeanors
201. Aiding and abetting - Actively participating in the commission of a crime without taking part in the actual criminal offense.
Half of the punishment for the assisted charge

202. Assault - An unlawful attempt, coupled with a present ability, to commit a violent injury upon another person.
40 minute arrest and a $9,000 fine

203. Auto burglary - Entering a locked automobile or its trunk with the intent to steal the vehicle, steal property contained in the vehicle, or commit any other crime inside the vehicle.
20 minute arrest and a $7,000 fine

204. Brandishing a weapon or firearm - Drawing, exhibiting, or using a firearm or deadly weapon.
25 minute arrest and a $7,500 fine

205. Breaking and entering - Forcibly entering into a structure.
15 minute arrest and a $6,500 fine
BAIL: 5 minute arrest and $35,000 bail

206. Burglary - Forcibly entering into a structure with intent to commit a crime.
20 minute arrest and a $7,000 fine
BAIL: 5 minute arrest and $36,500 bail

207. Contempt of court - Disobeying the direct order of a court official or authorized warrant.
20 minute arrest and a $7,000 fine

208. Criminal threats - A threat of immediate harm made to another person when the person making threats intends to, and does, cause fear in the person threatened.
10 minute arrest and a $6,000 fine

209. Disturbing the peace - Using offensive words in a public place which are inherently likely to produce a violent reaction or repeatedly issuing statements that represent conduct of a disorderly nature.
10 minute arrest and a $6,000 fine

210. Driving an unregistered vehicle - Operating a motor vehicle without visible or valid license plate tags.
10 minute arrest, $6,000 fine, one driver warning, and the vehicle impounded

211. Driving on a suspended license - Operating a motor vehicle with the knowledge that your license has been suspended or revoked.
15 minute arrest, $6,500 fine, license suspension extension, and the vehicle impounded

212. Driving under the influence - Operating a motor vehicle while one's physical or mental abilities are impaired by alcohol or a controlled substance to such a degree that they no longer have the ability to drive with the caution characteristic of a sober person of ordinary prudence under the same or similar circumstances.
25 minute arrest, $7,500 fine, license suspension, and the vehicle impounded

213. Driving without a license - Operating a motor vehicle without a valid driver's license.
20 minute arrest, $7,000 fine, and the vehicle impounded

214. Facial obstruction - Wearing any mask, false whiskers, or any personal disguise (whether complete or partial) for the purpose of avoiding recognition during the commission of a crime.

215. Failure to identify to a peace officer - Refusing to give information or withholding information regarding identification and all attempts by law enforcement to obtain said information have been absolved.

216. Failure to register an aircraft - Owning a helicopter or airplane that has not been registered with the Los Santos government.
20 minute arrest, a $7,000 fine, and an aircraft confiscation

242. Vandalism - Defacing, damaging, or destroying someone else’s property.

301. Aggravated battery - Causing serious bodily injury to another as a result of force or violence.
1 hour arrest and a $21,000 fine

302. Armed robbery - Taking someone else's property from the person's body or immediate possession when accomplished by force or fear with the use of a weapon.
6 hour arrest and a $20,000 fine
BAIL: 1 hour arrest and $115,000 bail

303. Arson - Willfully and maliciously, or recklessly, setting a fire to a property.
4 hour arrest and a $18,000 fine plus the cost of any damages.

304. Assault with a deadly weapon - An assault that is committed with any type of deadly weapon, such as a firearm, or by means of force that is likely to cause great bodily injury to another.
1 hour arrest and a $17,000 fine

305. Attempted murder - Taking at least one direct step towards killing another person with intent to kill that person.
1 hour arrest and a $22,000 fine

306. Attempted murder of a government employee - Taking at least one direct step towards killing an on duty government employee with intent to kill the official.

307. Battery - Willfully and unlawfully using force or violence upon another.
1 hour arrest and a $20,000 fine

308. Battery on a government employee - Committing a battery against a government employee while the individual was engaged in the performance of their duties, having known that they were a government employee engaged in the performance of their duties.
1 hour arrest and a $21,000 fine

309. Bribery - Giving anything of value or advantage, or making any promise or undertaking to give any, asked, given, or accepted, with a corrupt intent to influence, unlawfully, the person to whom it is given, in his or her action, vote, or opinion, in any public or official capacity.

351. Statutory rape - Engaging in sexual intercourse with a person under the age of 18.

353. Torture - Inflicting great bodily harm on another person with the specific intent to cause cruel or extreme pain.
1 hour arrest and a $22,000 fine

354. Unlicensed sale of firearms - Selling, leasing, or transferring firearms without a valid license to do so.
1 hour arrest and a $20,000 fine
BAIL: 1 hour arrest and $115,000 bail

355. Violation of a federal act - Violating the predicates of a federally mandated act.
1 hour arrest and a $21,000 fine

356. Voluntary manslaughter - An unlawful killing without malice aforethought.
